CLEAN and FLX Strong need to fund their lawsuit against the Town of Lansing Zoning Board of Appeals (ZBA) as well as TeraWulf, Inc., Cayuga Operating Company, LLC, Lake Hawkeye LLC and Fred Delfavero. In the suit, we are seeking judicial review in the State Supreme Court of New York (located in Ithaca) of the ZBA’s 3 to 2 vote on December 22nd, 2025, by which the ZBA narrowly approved the respondents’ appeal that a proposed TeraWulf data center did qualify as a “general processing facility.” Our attorney estimates that legal fees at the initial trial level in the Tompkins County Supreme Court will be in the range of $25,000-$30,000.  He estimates that our legal fees for the appeal of the ruling will be about $10,000 to $15,000.  And, we know that TeraWulf will appeal if we win at the Supreme Court level and that we will appeal if Judge Masler rules against us.

Thus, our total legal fees will likely be in the range of $35K to $50K. We are also budgeting $15,000 for consultant fees for noise and other studies that will be needed and for expenses such as organizing public protests.
